Chiko's Trailer & Plant Hire — Dry Hire Agreement

This Dry Hire Agreement is entered into between Chiko's Trailer & Plant Hire ("Owner") and the person named in the booking ("Hirer") for the dry hire of the equipment specified.

1. Dry Hire — No Operator Supplied

This is a DRY HIRE arrangement. No operator is supplied by the Owner. The Hirer accepts full responsibility for the safe and competent operation of all hired equipment and confirms they hold any required competencies.

2. Condition of Equipment

The Hirer agrees to collect equipment in good working order and return it in the same condition, clean and fuelled. Any damage, loss, or theft during the hire period is the sole responsibility and financial liability of the Hirer.

3. Use of Equipment

  1. Equipment must only be used for the purpose described in the booking.
  2. Equipment must not be sub-hired or operated by any third party without written consent.
  3. Equipment must not be used on public roads unless road-registered and appropriate.
  4. The Hirer must comply with all applicable WHS legislation and regulations.
  5. SWMS must be in place for any high-risk construction work as required by law.

4. Damage & Insurance

The Hirer is liable for all damage during the hire period. The Hirer is strongly advised to hold appropriate public liability insurance. The Owner accepts no liability for loss, injury, or damage arising from use of the equipment.

5. Bond

A security bond may be required. The bond will be returned following safe return of equipment in its original condition, less any deductions for damage, cleaning, or fuel.

6. Hire Period & Late Returns

Late returns will be charged at the applicable daily rate. The Hirer must contact the Owner as soon as practicable if an extension is required.

7. Breakdown & Maintenance

Breakdowns not caused by the Hirer may receive a pro-rata refund at the Owner's discretion. The Hirer must not attempt to repair equipment without consent. Breakdowns caused by misuse are the Hirer's cost.

8. Towing (Trailers)

The Hirer is responsible for ensuring their towing vehicle is rated and compliant to tow the hired trailer. The Owner accepts no liability for incidents resulting from non-compliant towing setups.

9. Governing Law

This Agreement is governed by the laws of New South Wales, Australia.

By completing this booking and checking the boxes below, the Hirer agrees to be bound by this Agreement.

FREQUENTLY ASKED

What is dry hire? +
Dry hire means you hire the equipment without an operator. You are responsible for operating the machine yourself. This keeps costs lower and gives you full control over your schedule.
Do I need a licence to operate the mini excavator? +
In NSW, there is no specific licence required to operate a mini excavator under 10 tonnes on private property. However, you must be competent to do so safely. For work near underground services, complete a DBYD enquiry. Always follow WHS regulations.
What tow vehicle do I need for the trailer? +
Your tow vehicle must be rated to tow the ATM of the hired trailer. Check your vehicle's tow rating in the owner's manual or on the compliance plate. You are responsible for ensuring compliance.
Is a bond required? +
Yes, a security bond is required for all hires. The amount depends on the equipment and will be communicated at booking. It is returned in full following safe return of undamaged equipment.
Can you deliver the equipment? +
Delivery may be available depending on location and equipment. Contact Charles directly on 0499 787 688 to discuss options and costs.
What if something breaks down? +
Contact Charles immediately on 0499 787 688. Breakdowns caused by fair wear and tear may be covered; those resulting from misuse are at the hirer's expense. Do not attempt to repair equipment without authorisation.
